Hope YANG has been practising IP law for more than 15 years. He has advised and represented many international and domestic rights holders across various industries on all manners of intellectual property litigation and counselling.
He is experienced in the enforcement of trademark rights and copyright, unfair competition litigation, domain name dispute resolution, IP strategy counselling, IP compliance consulting, IP transactions, well-known trademark recognition, and other intellectual property related contentious and non-contentious matters.
Before joining East IP, Hope worked at a full-service law firm, and previously an IP boutique law firm and international law firm.
IP Litigation
Hope has in-depth experience in IP litigation and handled hundreds of IP litigations, primarily focused on trademark, copyright, unfair competition. He has handled several influential intellectual property cases, including the first case of the Beijing Internet Court (copyright case, Top Ten IP cases of Chinese Courts in 2018); a trademark administrative litigation regarding the mark “江小白” before the Supreme People’s Court (SPC’s typical case in 2019, SPC’s Guiding Cases in 2021, No.162); a trademark infringement litigation regarding the mark “平安好医生” before the Sichuan High People’s Court (Top Ten IP Judicial Protection cases of Sichuan Province in 2019); a trademark infringement litigation regarding the mark “骄人” before Beijing IP Court (one of Ten Landmark cases on combating malicious trademark registrations issued by Beijing IP Court in 2023); trademark administrative lawsuits regarding the marks “奔富” and “奔富酒园” before the Supreme People’s Court; and an unfair competition lawsuit regarding the brand Penfolds brand before Shanghai Pudong New District People’s Court (the judgement was publicly pronounced as a part of series of publicity activities for “4.26” World Intellectual Property Day).
IP Enforcement
Hope is also experienced in general IP enforcement. He offers customized services for enforcing the client’s IP rights based on their legal and business needs, including cease and desist letters, negotiations, raid actions, and online taken downs.
Well-known Trademark Recognition
Hope is experienced in well-known trademark recognition. He has represented several clients in successfully obtaining well-known trademark recognition for several brands, such as Sohu (搜狐) and Penfolds (奔富).
IP Strategy Counselling and Compliance Consulting
Hope also handles non-contentious IP matters, including trademark strategy counselling and compliance consulting, from the perspectives of both trademark enforcement and trademark prosecution.
