Investigations & Enforcement

East IP is unique among IP service providers in China in that we operate a large team of specialist researchers and investigations managers who are adept in identifying and understanding infringer networks. They also work hand-in-glove with our IP professionals in gathering and preserving evidence and working with administrative enforcement authorities and police in pursuing enforcement measures.

Most of the work of our investigations and enforcement specialists is focused on the following:

  • Customs recordal and border enforcement measures
  • Trademark infringement
  • Audits and training for inhouse IP protection teams

The In-House Perspective

Many of our senior team members have extensive in-house experience managing brand protection and supply chain integrity programs for global consumer goods companies. Some have also deep experience working in the China offices of major international commercial investigations firms.

While we routinely assist clients on a case-by-case basis, our team can best assist clients when working on a portfolio basis, thereby allowing us to address infringement challenges in a more strategic manner. Such portfolio-based programs will typically include assistance in organizing civil actions and negotiations to recover compensation following administrative and criminal raids.

Working Well with Government

East IP partners are also respected in the market for their ability to establish positive working relationships with local law enforcement authorities – including police, prosecutors and Market Supervision Bureaus (MSBs). This is achieved largely by anticipating the needs of these authorities for support in gathering and analyzing evidence, as well as in providing required documentation and legal analysis, where needed.

Collective Action

East IP appreciates the opportunity to represent coalitions of victim brands in dealing with common challenges, as this normally results in significant cost savings as well as a greater chance of achieving better results when advocating with local authorities for priority attention to their cases.

East IP partners have for many years represented clients in associations such as the Quality Brands Protection Committee (QBPC), often taking leadership roles in these groups.  We routinely assist clients in leveraging association membership in our advocacy work over serious IP infringement matters with national as well as local authorities.

Conducting deep investigations with police support against large and complex networks of counterfeiters and suppliers of components, resulting in large-scale criminal raids, arrests and criminal and civil decisions that generate custodial jail sentences and significant compensation.

Online Enforcement

Assisting clients in “online-to-offline” investigations, including structuring survey and purchase programs intended to achieve timely identification of the source of fakes.
